Fish DOA/Guarantee?

I was hoping that i can get some feedback on a recent transaction. I'm trying to ground truth that I'm not being unreasonable with an online fish seller or if I did something wrong so that I can avoid doing it again in the future.

I recently ordered a regal angel and a Solon wrasse. This isn't one of our vendors and I will refrain from naming them at this point in the event that I'm at fault. The vendors webpage clearly states that the regals aren't covered by their normal 14 day guarantee but there is a live arrive policy. This is reasonable since they are known to be hard to get to eat and finicky about water quality.

I had the delivery made to fedex and I picked it up first thing in the morning when they opened. When I picked up the box I noticed that one of the corners was slightly wet. The box wasn't damaged. I got home about 15 minutes later and opened it up. The bag that the regal was in had leaked into the cooler and was partly deflated. There was still water in the bag but the fish wasn't looking good. I floated both bags for about 10 minutes and then transferred the water and the fish from the bags into a bucket. The regal just laid on its side and was barely breathing. The wrasse was doing fine. After checking the salinity I started drip acclimating, covered the bucket and turned off the lights. I checked on the fish and the salinity about every ten minutes. After about 30 or 40 minutes I drained off some of the water and continued dripping. At that point the condition of the regal wasn't any better and it's gills stopped moving about 10 or 20 minutes later. Once the salinity was close to my qt I transferred the wrasse. Its doing fine.

I kept the seller notified of what was going on as it happened. I heard back from him later in the afternoon when he asked how I acclimated it. I gave him a summary and asked if he considered this DOA. That was yesterday and I haven't heard back from him yet. I'm of the opinion that an issue with the packing was the problem and that I should be refunded. I don't want to read too much into him not getting back to me yet and before I push him on this I want to make sure that I'm being fair and not to blame with how I handled it. Any thoughts are appreciated.

Its up to him what he does at this point,theres a gray area here in my opinion.
It did arrive alive but not in the best of shape but hopefully he will take care of you,I think I know who your are dealing with and he is usually good about this type of problem.
 
If the bag leaked out and the fish was near dead. The vendor is responsible. We had the same thing happen to us. With an online vendor. The fish was replaced by them.

those are awesome fish. im sorry about the loss. i wouldve just told him it was DOA, instead of doing the honest thing. i definitely agree that it was a packaging problem, but as the others stated, it really depends on what kind of guy the seller is. and there really is a gray area because it technically arrived alive and you told him that. if they want to do the right thing then they would replace the fish. if not he/she probably wont be in business much longer operating like that.
 
Thanks for the feedback. I haven't received a response from him yet. I'm going to send another message politely stating my opinion and see what he says.
 
Mike you did the right thing by being honest. I'm sure they will make it right. No good comes from being dishonest and for anyone to suggest that you should not have been honest is crazy.

Small stores do not want to refund, replacement or give credit for dead fish because this is 'their' money. Large places (like petco.com)have no problem with sending replacement even if overnight shipping cost much more than the fish.

Mike, I think you did everything right (including being honest) and apparently, the vedor did the right thing too.

Glad it all worked out, but sorry to hear about the fish.
 
mike, as a member you could share more details if you want in the members only forum. Not saying you should or shouldn't- i respect your desire to keep it anonymous. The curious side of me is wondering which vendor. I'm glad they fixed the situation - and sorry you had to go thru this.

I was hesitant to name the vendor because this is my first time dealing with them. I'm not sure that it would be fair to judge them based on this single experience. It sucks that the fish died but the bag leakage could have been from handling by handling by fedex, packing issues or just one of those things. In the end the vendor gave me a credit without any arguments so I'm satisfied with how he handled it and already ordered another one.
 
I'm pretty sure live aquaria only issues a refund or credit for the cost of the item lost.
